Welcome to Smart Claimz® (“we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your use of our website smartclaimz.co.uk and our services. By accessing or using our website and services, you agree to comply with these Terms. If you do not agree, please do not use our website.
1. Who We Are
Smart Claimz® is a UK-based business that helps merchants recover expired and unredeemed vouchers from Groupon and similar platforms.

2. Use of Website
• The content on our website is provided for general information only.
• You must not misuse our website by knowingly introducing viruses, attempting to gain unauthorised access, or using it for unlawful purposes.
• We may update, suspend, or withdraw any part of the website at any time without notice.
3. Our Services
• We assist businesses in recovering expired or unredeemed vouchers from Groupon and similar platforms.
• Our service operates on a “no win – no fee” basis: if we do not successfully recover funds for you, no fee is charged.
• If we do recover funds, the agreed commission (typically 50% of the recovered amount) will be payable to Smart Claimz®.
• The recovery process does not affect your existing or future trading arrangements with Groupon.
4. Client Responsibilities
By engaging our services, you agree to:
• Provide accurate and complete information regarding your voucher sales.
• Authorise us to communicate with Groupon (or similar platforms) on your behalf, where necessary.
• Respond promptly to our requests for information or documents.
5. Fees & Payment
• Fees are charged strictly on a success-only basis.
• The standard fee is 50% of the recovered amount, unless otherwise agreed in writing.
• Payment is due within 14 days of invoice.
• Late payments may incur interest at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998.
6. Limitation of Liability
• We make every reasonable effort to recover vouchers, but we do not guarantee any particular outcome.
• We are not liable for:
– Losses resulting from incorrect or incomplete information provided by you.
– Any indirect, incidental, or consequential losses.
• Our total liability under these Terms is limited to the amount of fees paid by you to us.
7. Confidentiality & Data Protection
• We will treat all client data as confidential.
• We comply with the UK GDPR and Data Protection Act 2018.
• Our Privacy Policy explains how we handle your personal data.
8. Intellectual Property
• All website content (text, graphics, logos, design, etc.) belongs to Smart Claimz® or its licensors.
• You may not copy, reproduce, or distribute our content without prior written consent.
9. Termination
• You may terminate our engagement at any time before we submit a claim on your behalf.
• Once a recovery process has been initiated, our standard fees will apply to any recovered funds.
• We may terminate our services if you breach these Terms or fail to cooperate.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time. Updated versions will be posted on this page with a new “Last updated” date.
